    Purpose of the Privacy Policy

    Zoo Zürich AG (hereinafter «Zoo Zurich») is the operator of the online Platform zoo.ch, through which Zoo Zurich offers its products (including tickets, vouchers, gift cards, Zoo products, events, seminars, courses) and customers can purchase them (hereinafter «Platform»), as well as the operator of Zoo WiFi, which provides Zoo visitors with Internet access on the Zoo premises to the extent which it is technically, operationally and economically feasible. Furthermore, Zoo Zurich offers certain functionalities via an app (including ticket purchase, storage of the annual pass). Finally, Zoo Zurich also processes certain personal data provided by users, customers or interested parties via telephone communication or email.

    Data protection is very important to Zoo Zurich and Zoo Zurich complies with applicable data protection laws and regulations.

    This privacy policy describes how Zoo Zurich handles personal data and, in particular, sets out which personal data is processed by Zoo Zurich and the purposes for which this data is processed. It also describes how collected personal data can be reviewed, rectified or erased.

    This privacy policy does not extend to any external links that lead to third-party offers. The data protection provisions of the respective provider apply to these offers.

    This privacy policy is an integral part of the Zoo Zurich GTCs, which are available at zoo.ch/agb.

    Data processing when using the platform and the zoo app

    1. When visiting the Platform/Zoo App

    When visiting the Platform or the Zoo App, the servers temporarily store each access in a log file. The following data is collected without further action by the user:

    • IP addresses;
    • Date and time;
    • Protocol information such as protocol type, version, the desired action, status codes or information about the transferred data (e.g. the size of a question or an answer);
    • Error messages;
    • Depending on the application-specific information, such as message IDs in the case of emails, or, in the case of web access, information about the browser used (user agent string) or, if applicable, the page from which the visitor accessed the website.

    When using the Zoo App, the following information, among others, is collected and processed:

    • Device information such as the device type, operating system, IP address, language settings, device identifiers, cookie data.

    The data remains on our systems until the operational necessity ceases and the statutory or contractual time limits expire, after which it is automatically erased. For most data, this is a maximum of half a year.

    This data is generally collected and processed anonymously without reference to individuals for the purpose of enabling the use of the Platform or the Zoo App (establishment of a connection), ensuring system security and stability on a permanent basis and optimizing the Internet offering, as well as for internal statistical purposes. The aforementioned information is not linked to or stored with personal data.

    Only in the event of an attack on the network infrastructure of the Platform/Zoo App or if there is a suspicion of other unauthorized or abusive Platform/Zoo App use will the IP address be evaluated for the purpose of clarification and defense and, if necessary, used in the context of criminal proceedings to identify and take civil and criminal action against the users concerned.

    Finally, Zoo Zurich uses cookies as well as applications and tools based on the use of cookies when visiting the Platform/Zoo App. In this context, the data described here can also be processed. Further details can be found in the other subsequent sections of this privacy policy, in particular in the section «Cookies».

    2. When downloading and using the Zoo App

    When you download the Zoo App, the operators of the relevant app store collect and process the following data:

    • User name;
    • E-mail address;
    • Customer number of the user at the relevant app store;
    • Time of download;
    • Payment information, if applicable; and
    • Mobile end device identification number.

    By downloading the Zoo App from the Apple App Store or Google Play Store, users have legitimized themselves to the respective app store, e.g. via their Apple ID. Apple's and Google's privacy policies currently do not fully comply with the requirements of the European General Data Protection Regulation (GDPR). Zoo Zurich therefore cannot rule out the possibility that Apple or Google may use the data collected in connection with the download or use of the apps in a manner that is not in compliance with European law. Zoo Zurich has no influence on this. However, Zoo Zurich does not share any data with Apple or Google.

    The use of all functionalities of the Zoo App may require users to grant certain permissions. This may be necessary, for example, for the following purposes:

    • Location: The Zoo App may require authorization to access location data for certain functionality. This may be necessary in particular to ensure that the Bluetooth function works technically correctly. Other location data will not be processed without appropriate information and consent from Zoo Zurich.
    • Push messages

    When users start the Zoo App for the first time or if a service of the Zoo App requires access to certain functions of the end device, users are asked for their consent. Users can change the permissions granted at any time in the settings of the end devices. As described, certain permissions are required in order to use functionalities in the Zoo App in the first place. If the relevant permissions are revoked, the Zoo App may no longer be able to provide the relevant functionality correctly.

    3. When opening a user account/logging in to an existing user account

    It is possible to visit the Platform/Zoo App without opening a user account. Certain bookings/reservations on the Platform/Zoo App can also be made without a user account. Certain functionalities, on the other hand, are only available to registered users.

    When opening the user account, the following data is collected:

    • E-mail address
    • Password/username

    The data in the user account can be viewed and changed at any time. Finally, users can request the complete erasure of the account. If users wish to delete their user account, they must send a request to Zoo Zurich (see «Contact» below).

    Zoo Zurich uses the personal data to establish the identity of users and to verify the requirements for registration. The email and password together serve as login data and thus to ensure that the correct person is using the Platform/Zoo App under the details of the relevant users . Zoo Zurich also requires the email address of the users for verification and confirmation of the account opening and for future communication with the users required for the provision of services. In addition, this data is stored in the user account for future services. For this purpose, Zoo Zurich also allows users to enter additional information in the account.

    Zoo Zurich also uses the data to provide an overview of the services ordered and a simple way to manage the personal data of the users, to administer the Platform/Zoo App and the contractual relationships, i.e. to establish, define the content of, process and amend the contracts concluded with the users via their user account.

    In addition, Zoo Zurich may use the information in the user account or information about services requested by users that is linked to the user account to send personalized communications to users if the requirements are met (see «Newsletter» below). Finally, Zoo Zurich can also use the information in the user accounts for statistical analyses.

    4. When using functionalities and services

    Personal data is actively collected and processed when users make use of services and functionalities offered by Zoo Zurich on the Platform/Zoo App. The use of these services and functionalities is voluntary. Users decide which services and functionalities they want to use and which personal data they want to pass on to Zoo Zurich.

    In the case of services, Zoo Zurich specifies to users which information Zoo Zurich requires in order to provide the services (and which, if any, is additionally provided voluntarily). The users decide voluntarily whether they want to provide Zoo Zurich with the data. If users do not wish to provide Zoo Zurich with necessary information, they will not be able to use certain services and functionalities.

    Special mention should be made of the following functionalities and services:

    Donations

    Users can donate directly to specific projects via the Platform. For this purpose, users must provide the following personal data, among others:

    Project for which the users would like to make a donation;

    • Donation amount;
    • Title;
    • Name and surname;
    • Company (if it is a corporate donation);
    • Street, ZIP code, city);
    • Telephone number;
    • E-mail;
    • Comments;
    • Payment method and payment information, depending on the method.

    The preceding information is mandatory.

    Zoo Zurich processes this personal data in order to execute the donation (payment of the donation, control of the receipt of the donation). For this purpose, Zoo Zurich also passes on certain data to its payment service providers. Zoo Zurich also takes the liberty of using the contact data to thank donors. Lastly, the contact details can also be used to get in touch with the potential donors in order to clarify ambiguities and open questions about the donation.

    Event inquiries

    If users want to hold an event at Zoo Zurich, they can submit the request directly via the Platform. It is of course possible to make event inquiries by phone or email.

    The following personal data are required for event inquiries:

    • Desired date;
    • Planned start time;
    • Desired location (e.g. Masoala restaurant);
    • Number of persons;
    • Description of the occasion;
    • Title;
    • Name and surname;
    • Company;
    • Street, ZIP code, city;
    • Telephone number;
    • E-mail.

    The above information is mandatory.

    Zoo Zurich processes this data in order to get an overview of the planned event and to contact interested parties afterwards. The purpose of contacting us is to discuss the event, to make an offer and to organize and hold the event. In this context, further personal data may be collected which are necessary for the organization and implementation of the event. Information on individual events may also be processed by Zoo Zurich in aggregated form for statistical purposes.

    In addition, the contact data will be used to send the event customers information about current event offers in the future. For more information on these data processing operations and on how to object to receiving information, please refer to the «Newsletter» section below.

    Sponsorship application

    Users can apply for sponsorship directly via the Platform. Users must provide the following information:

    • Select sponsor animal/plant,
    • Title;
    • Name and surname;
    • Company (if it is a corporate sponsorship);
    • Street, ZIP code, city;
    • Telephone number;
    • E-mail;
    • Start of the sponsorship;
    • Nomination on the digital patent board (Yes/No);
    • Whether the sponsorship is a gift;
    • Details of the person receiving the gift (if sponsorship is to be a gift);
    • Comments.

    The preceding information is mandatory.

    Zoo Zurich processes this information in order to check the application, to contact potential sponsors, to clarify open questions, to carry out and organize the sponsorship and to administer the various sponsorships. Zoo Zurich takes the liberty of using the contact data to thank sponsors for their sponsorship and to inform sponsors about news concerning their sponsored animal/plant.

    Group registrations

    Groups can register for tours directly through the Platform. Registrations are also possible by phone or email. Users must provide the following information:

    • Type of group;
    • Date;
    • Estimated time of arrival;
    • Group name/School name:
    • Street, ZIP code, city;
    • Title;
    • First name and surname of the contact person;
    • Mobile telephone number;
    • E-mail;
    • Number of visitors;
    • RailAway Ticket yes/no;
    • Reservation in a Zoo restaurant (yes/no);
    • Comments.

    This information is mandatory.

    Zoo Zurich processes this information in order to check and process the group registration, to organize and carry out the Zoo visit and, if requested, to make restaurant reservations. The contact information is also used to contact the group's contact person and to clarify details of the visit. If necessary, Zoo Zurich is entitled to forward contact data to third-party service providers. Lastly, Zoo Zurich may process the information in aggregated form for statistical purposes.

    Inquiries for guided tours

    Users can submit inquiries for guided tours at Zoo Zurich directly via the Platform. It is also possible to make inquiries by phone or email. For this purpose, the following information is mandatory:

    • Guided tour for adults / children;
    • Desired date;
    • Desired start time;
    • Desired duration;
    • Requested language of the guided tour;
    • Number of participants (adults/children);
    • Aperitif (yes / no);
    • Title;
    • First name and surname of the contact person;
    • Company (if it is a tour for a company);
    • Street, ZIP code, city;
    • Telephone number;
    • E-mail;
    • Comments.

    For school class inquiries, the following additional information is required:

    • School grade;
    • Number of students;
    • Number of accompanying persons;
    • Organization of travel (Yes/No).

    Zoo Zurich processes this information in order to check and process the inquiries, to organize and conduct the tour and, if requested, to arrange travel. The contact information will also be used to get in touch with the contact person to clarify details of the tour. If necessary, in particular with regard to the organization of travel, Zoo Zurich is entitled to forward contact data to third-party service providers. Lastly, Zoo Zurich may process the information in aggregated form for statistical purposes.

    Registration for courses, guided tours, seminars and culinary events

    Users can register directly on the Platform for courses, guided tours, seminars and culinary events. Which courses, guided tours, seminars as well as culinary events are available and the details of the events are provided on the Platform. Registrations can also be made by email or phone.

    In each case, the registration mask specifies which information is mandatory for registration. As a rule, the following information is mandatory:

    • Date (in case of different dates on which events are held);
    • Number of participants (number of adults/number of children);
    • Title;
    • First name and surname of the contact person;
    • Street, ZIP code, city;
    • Mobile telephone number;
    • E-mail;
    • Voucher/gift card number (if available);
    • Payment information (if there is a charge for the event);
    • Number of meat, fish, vegi menus (at culinary events);
    • Comments.

    Zoo Zurich processes this information in order to check and process the registration and to organize and carry out the relevant courses, guided tours, seminars as well as culinary events. The contact information is also used to contact the contact person to clarify details. If necessary, Zoo Zurich is entitled to forward contact data to third-party service providers (e.g. payment service providers, restaurant operators). Lastly, Zoo Zurich may process the information in aggregated form for statistical purposes.

    Ordering annual passes for companies

    Companies can order annual passes for their employees and customers directly via the Platform. These annual passes are transferable. The following information is mandatory for this order:

    • Company logo (upload);
    • Number of individual cards;
    • Validity date;
    • Title;
    • Surname and first name of the contact person;
    • Company;
    • Street, ZIP code, city;
    • Telephone number;
    • E-mail;
    • Invoice address.

    Zoo Zurich processes this information in order to check and process the order and to issue the annual passes and send them to the contact person. The contact information is also used to contact the contact person to clarify details. If necessary, Zoo Zurich is entitled to forward contact data to third-party service providers (e.g. card manufacturers, payment service providers). Lastly, Zoo Zurich may process the information in aggregated form for statistical purposes.

    Online shop / in-app purchases

    If users wish to purchase a product on the Platform in the Zoo Zurich Online Shop or in the Zoo App (e.g. admission tickets), various personal data are collected for the purpose of processing the purchase.

    It is mandatory for users to provide the following data:

    • Company (if it is an order for a company);
    • Title
    • Name and surname;
    • Mailing address/delivery address;
    • Country;
    • Telephone number;
    • E-mail address;
    • Payment details (depending on the selected payment method).

    Any further data provided is done so voluntarily.

    This data will be stored in the user account if the purchase is made as a registered user.

    In connection with orders placed in the Zoo Zurich Online Shop or in the Zoo App and with the processing of orders, Zoo Zurich additionally collects, stores and processes the following data:

    • Information about the ordered products;
    • Information about the ordered services;
    • Data on ordering, purchasing and payment behavior.

    Unless otherwise stated in this privacy policy, or unless the users have separately consented to this, Zoo Zurich will only use the aforementioned data to process the contract, namely, to process the orders, to deliver the ordered products and to ensure correct payment.

    Purchase and storage tickets

    Tickets can be purchased either in the Zoo Zurich Online Shop, in the Zoo App or at the entrance box office.

    For purchases in the Zoo Zurich Online Shop/Zoo App, the explanations in the section «Zoo Zurich Online Shop/Zoo App purchases» apply. Tickets purchased online can be stored in the Zoo App, provided that the purchase was made as a registered user. This allows customers to scan tickets at the gate directly from the Zoo App.

    No personal data is collected when purchasing single tickets at the entrance ticket office. On the other hand, personal data is collected when an annual pass is purchased. These include:

    • Title;
    • Name and surname;
    • Address;
    • ZIP code;
    • City;
    • Country;
    • E-mail address;
    • Telephone number;
    • Date of birth;
    • Photo (depending on the sales channel, a corresponding upload).

    The annual pass can also be stored in the Zoo App.

    Unless otherwise stated in this privacy policy, or unless the customer has separately consented to this, Zoo Zurich will only use the aforementioned data to process the contract, namely, to issue the annual pass, to deliver the ordered annual pass and to ensure correct payment. Zoo Zurich may also involve third-party service providers for this purpose (e.g. financial service providers).

    The photos for the annual passes are stored digitally on behalf of Zoo Zurich on servers of the company Hostpoint, Neue Jonastrasse 60, 8640 Rapperswil-Jona, Switzerland. Zoo Zurich ensures on a contractual basis that Hostpoint only processes the digital image data in a manner that Zoo Zurich would be permitted to do.

    In addition, the contact details of annual pass holders are used to inform them by email or via the app about news related to the use of the annual pass (e.g. special promotions for annual pass holders, reminders regarding renewal of the annual pass). The holders can object to the delivery of this information at any time (by email to jahreskarten@zoo.ch). Despite objections, Zoo Zurich will continue to inform the holders about changes to the contractual conditions for the annual pass or also about the expiry of the validity of the annual pass.

    Competition

    For participation in competitions conducted via the Platform or outside of it, Zoo Zurich requires and processes the email address and the postal address of the participants for the organization and implementation of the competition as well as the delivery of the prize. Winners will be notified by Zoo Zurich via email. If further information is required or the information is processed for additional purposes, this will be made transparent in connection with the competition.

    Use of Zoo Wifi

    The following data is collected in connection with the use of Zoo WiFi:

    • MAC address of the end device;
    • Every time a customer uses the website, data on the areas of Zoo Zurich visited, including the time, date and end device, is recorded;
    • Usage and boundary data;
    • Title
    • Name and surname
    • E-mail address

    The usage and boundary data are stored for one month on a personalized basis and then deleted. The contact data will be destroyed from the moment of withdrawal of participation in the WiFi service or twelve months after registration.

    In exchange for using Zoo WiFi, by registering users agree that Zoo Zurich may send them the Zoo Newsletter. For this purpose, the email address provided during registration will be processed. The provisions in the «Newsletter» section below apply to the Zoo Newsletter and the withdrawal of consent.

    Cookies

    Cookies are small files that make it possible to store specific information related to the device on the user's access device (PC, smartphone, etc.). On the one hand, they serve to ensure the user-friendliness of websites and therefore are beneficial to the users. On the other hand, they are used to collect statistical data on website usage (e.g. advertising banners clicked on, sub-pages visited, etc.) and to be able to analyze them for the purpose of improving the offer.

    There are basically two different types of cookies. On the one hand, session cookies, which are only stored for a particular visitor session. This means that the cookies are automatically deleted immediately when the respective service is closed by the users. On the other hand, temporary/permanent cookies that are stored for a longer period of time or indefinitely on the user's data carrier. These cookies are necessary in order to recognize which users are involved and which settings and entries these users require when they visit the site. These cookies remain on the hard drive and delete themselves after the specified time.

    Users can influence the use of cookies by agreeing to or rejecting the use of cookies on the zoo.ch website when the cookie banner is displayed. In addition, most browsers have an option to restrict or completely prevent cookies from being saved. However, it is pointed out that the use and especially the ease of use will be limited without cookies.
    How to disable cookies in the most popular browsers:

    Zoo Zurich will use automatically stored information exclusively for statistical analyses and, in particular, will not associate it with any personal data provided to Zoo Zurich.

    Google Analytics

    The Platform uses Google Analytics, a web analytics service provided by Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland, or Google Inc. 1600 Amphitheater Pkwy, Mountain View, CA 94043-1351, USA («Google»). Google Analytics uses methods that enable an analysis of the use of the Platform, such as «cookies». These generate information about the use of the Platform, such as

    • Browser type/version;
    • Operating system used;
    • Referrer URL (the previously visited page);
    • Host name of the accessing computer (IP address);
    • Time of the server request;
    • Device;
    • Pages accessed;
    • Orders including sales and products ordered as well as the composition of the shopping cart (this information is disclosed to us by Google primarily in aggregated form for statistical purposes);
    • Achieving «website goals» (e.g., contact inquiries and Newsletter sign-ups);
    • Behavior on the pages (e.g., dwell time, clicks, scrolling behavior); and
    • Approximate location (country and city).

    This information is transferred to Google servers in the USA and stored there. In doing so, the IP address is shortened by activating IP anonymization («anonymizeIP») on the Platform before transmission within the Member States of the European Union or in other contracting states of the European Economic Area Agreement or Switzerland. The anonymized IP address transmitted by the user's browser as part of Google Analytics is not merged with other Google data. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. In these cases, Zoo Zurich ensures through contractual guarantees that Google complies with a sufficient level of data protection.

    The information is used to analyze the use of the Platform, to compile reports on website activity and to provide other services related to website and Internet use for the purposes of market research and demand-based design of this Platform. This information may also be transferred to third parties if this is required by law or if third parties process this data on our behalf. According to Google, in no case will the IP address be associated with other data concerning the user.

    Users can prevent the collection of data generated by the cookie and related to their use of the Platform (including your IP address) for Google and the processing of this data by Google by rejecting the use of cookies by means of the cookie banner displayed or by downloading and installing the browser plugin available under the following Link.

    As part of the advertising measures through Google Ads, Zoo Zurich uses conversion tracking, which is offered by Google Ireland Ltd, Gordon House, Barrow Street Dublin 4, Ireland («Google»).

    Zoo Zurich uses this service to better adapt the ads to the interests and needs of the users. Google's conversion tracking records what happens after a user clicks on a Zoo Zurich ad. With the conversion tracking tool, Zoo Zurich can see which keywords, ads, ad groups and campaigns have led to the desired customer actions. This allows Zoo Zurich to measure the success of the ads and optimize the advertising measures. In addition, the information helps Zoo Zurich to make the website more interesting and to adapt the advertising offer even better to individual needs.

    Zoo Zurich has included a conversion tag or code snippet on the website. When users click on a Zoo Zurich ad, Google Adwords stores a cookie on their computer or mobile device. As soon as users visit the Zoo Zurich website afterwards, Google recognizes the cookie and stores the users' activities on the website. The unique cookie ID, the number of ad impressions per placement (frequency), the last impression (relevant for post-view conversions) and opt-out information (marking that the user no longer wishes to be addressed) are usually stored as analysis values for this cookie.

    As long as the cookie is valid, Google and Zoo Zurich, as the website operator, can recognize that users have clicked on an ad and have reached a specific target page on the Platform. These cookies cannot be tracked across multiple platforms by different Ads participants. The cookie creates conversion statistics in «Google Ads». These statistics record the number of users who have clicked on a search ad. In addition, it counts how many users have reached a target page that has been tagged with a «conversion tag». However, the statistics do not contain any data that can be used to identify users.

    The ad server cookies usually lose their validity after a maximum of 90 days and are not intended to identify users personally.

    Zoo Zurich itself does not collect or process any personal data during this tracking. Zoo Zurich only receives the aforementioned statistical analyses from Google. In particular, Zoo Zurich cannot identify users from this information.

    Users can prevent participation in this tracking process in various ways:

    • a) by setting the browser software accordingly; in particular, suppressing third-party cookies means that users do not receive ads from third-party providers;
    • b) by deactivating cookies for conversion tracking by setting the browser to block cookies from the domain www.googleadservices.com, whereby this setting is deleted when users delete cookies;
    • c) by permanently deactivating them in the browser under the following Link,
    • d) using the appropriate cookie setting.

    Zoo Zurich would like to point out to users that in this case they may not be able to use all the functions of this website to their full extent.

    Google remarketing

    In addition to Google Ads Conversion Tracking, Zoo Zurich uses the Google Remarketing application. This is a procedure with which the users can be addressed again. This application enables Zoo Zurich to display its advertisements to users who continue to use the Internet after visiting the Platform. This is done by means of cookies stored in the user's browser, which are used by Google to record and analyze the user's behavior when visiting various websites. In this way, Google can determine the user's previous visit to the Platform. According to its own statements, Google does not merge the data collected in the course of remarketing with personal data of users that may be stored by Google. In particular, according to Google, pseudonymization is used in remarketing.

    Users can prevent the use of these cookies for targeted advertising on Google services and several other providers (in the Digital Advertising Alliance) (https://www.networkadvertising.org/choices/). Users can also stop these cookies by making the appropriate settings in their browser.

    Google doubleclick

    DoubleClick by Google is a service by Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland, or Google Inc. 1600 Amphitheater Pkwy, Mountain View, CA 94043-1351, USA («Google»). DoubleClick by Google uses cookies to present users with ads that are relevant to them. A pseudonymous identification number (ID) is assigned to the user's browser in order to check which ads were displayed in the browser and which ads were retrieved. The cookies do not contain any personal information. The use of DoubleClick cookies only enables Google and its partner websites to serve ads based on previous visits to the Zoo Zurich website or other websites on the Internet. The information generated by the cookies is transferred by Google to a server in the USA for analysis and stored there. Data is only transferred by Google to third parties on the basis of legal regulations or in the context of data processing. Under no circumstances will Google merge the data with other data collected by Google.

    Users can prevent the storage of cookies by rejecting them in the cookie banner or by selecting the appropriate settings in the browser software. However, Zoo Zurich points out to users that in this case they may not be able to use all functions of the Platform to their full extent. Users can also prevent the collection of data generated by the cookies and related to the use of the Platform for Google and the processing of this data by Google by downloading and installing the browser plugin available under the following Link  under the item DoubleClick deactivation extension.

    Google recaptcha

    The Platform uses the reCAPTCHA service of Google Inc. (1600 Amphitheater Parkway, Mountain View, CA 94043, USA; «Google»). The purpose of the request is to distinguish whether the input is made by a human or by automated, machine processing.

    For this purpose, reCAPTCHA analyzes the behavior of users based on various characteristics. This analysis begins automatically as soon as users enter the Platform. For analysis purposes, reCAPTCHA analyses various pieces of information (e.g. IP address, length of time users spend on the Platform or mouse movements made by users). The data collected during the analysis is forwarded to Google. The reCAPTCHA analyses run entirely in the background.

    The request includes the sending of the IP address and possibly further data required by Google for the reCAPTCHA service to Google. For this purpose, the user's input is transmitted to Google and further used there. However, Google will truncate the IP address beforehand within Member States of the European Union or in other contracting states of the European Economic Area Agreement or Switzerland. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. On behalf of the operator of this Platform, Google will use this information to analyze the use of this service by users. The IP address transmitted by the user's browser as part of reCAPTCHA is not merged with other Google data. The user's data may also be transmitted to the USA.

    Facebook remarketing

    So-called «Facebook pixels» of the social network Facebook are used within the Platform. With the help of the Facebook pixel, it is possible for Meta Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA, to determine the users of the Platform as a target group for the display of advertisements, so-called «Facebook ads». Accordingly, Zoo Zurich uses the Facebook pixel to display Facebook ads only to Facebook users who have shown an interest in the Zoo's website. This means that the Facebook pixel is used to ensure that the Facebook ads correspond to the potential interest of the users and do not have a harassing effect. With the help of the Facebook pixel, Zoo Zurich can also track the effectiveness of Facebook ads for statistical and market research purposes by seeing whether users were redirected to the Platform after clicking on a Facebook ad.

If users subsequently log in to Facebook or visit Facebook while logged in, their visit to the Platform is recorded in their profile. The data collected about the users is anonymous for Zoo Zurich and therefore does not allow any conclusions to be drawn about the identity of the users. However, the data is stored and processed by Facebook, so that it is possible to make a connection to the respective user profile. The data is processed by Facebook within the framework of Facebook's data policy. Accordingly, users receive further information on how the remarketing pixel works and generally on the display of Facebook ads, in Facebook data policy.

    Users can object to the collection by the Facebook pixel and the use of their data to display Facebook ads. To do this, users can retrieve Facebook's configured page and follow the information there regarding the settings for usage-based advertising. The settings are platform-independent, i.e. they are applied to all devices, such as desktop computers or mobile devices.

    Linkedin insight tag

    Within the Platform, so-called «LinkedIn Insight Tags» of the social network LinkedIn, LinkedIn Corporation, 1000 W. Maude Avenue, Sunnyvale, CA 94085, USA, are used. With the help of the «LinkedIn Insight Tag», LinkedIn is able to determine the users of the Platform as a target group for the display of advertisements, so-called «LinkedIn Ads». Accordingly, Zoo Zurich uses the «LinkedIn Insight Tag» to display the «LinkedIn Ads» only to those LinkedIn users who have shown an interest in the Zoo's website. This means that with the help of the «LinkedIn Insight Tag» it is ensured that the «LinkedIn Ads» correspond to the potential interest of the users and do not have a harassing effect.     Links to Zoo Zurich's social media profiles on the following social networks are included on the Platform:

    When users click on the relevant social network icons, they are automatically redirected to the Zoo Zurich profile on the relevant network. In order to use the functions of the network in question, users must log in to their user account with the network in question.

    When users retrieve a link to one of Zoo Zurich's social media profiles, a direct connection is established between the users' browser and the server of the social network in question. This provides the network with the information that the users have visited the Platform with their IP address and retrieved the link. When users retrieve a link to a network while logged into their account with that network, the content of the Platform can be linked to the users' profile with the network, which means that the network can directly associate the visit to the Platform with the users' account. If users wish to prevent this, they should log out before retrieving the corresponding links. In any case, an assignment takes place when the user logs in to the relevant network after activating the link.

    Newsletter

    With the Newsletter, Zoo Zurich provides information about current news and offers. The Newsletter is sent using the «Inxmail» mailing platform of the company Inxmail, Wentzingerstrasse 17, 79106 Freiburg im Breisgau, Germany.

    If users wish to receive the Newsletter, a valid email address, title, first and last name, as well as information that allows us to verify that the owners of the specified email address agree to receive the Newsletter. No other data is collected. By signing up to the Newsletter, we store the IP address of the users and the date of sign-up. This storage serves solely as evidence in the event that a third party misuses an email address and registers to receive the Newsletter without the knowledge of the user.

    It is also important to Zoo Zurich to determine which content is of interest to users in order to constantly improve the Zoo Newsletter. Zoo Zurich therefore reserves the right to use analysis tools that allow it to recognize whether and when users have opened the Newsletter and which news items are retrieved («click behavior»). For technical reasons, this information can be assigned to the individual Newsletter recipients, but no personal analysis takes place. To prevent the use of the so-called tracking pixel in the Newsletter, if this is not already the case by default, the email program must be set so that no HTML is displayed in messages. On the following pages, users will find explanations on how to make this setting in the most popular email programs.

    Users can revoke their consent to the storage of data, the email address and its use for sending the Newsletter at any time. The revocation can be made via a link in the Newsletter itself or by sending a message to the contact options below (see section «Contact»).

    Storage of data in central database

    The personal data mentioned in this privacy policy is stored and processed centrally by Zoo Zurich. E-commerce data as well as data that users enter into the various forms on the Platform are stored on servers of Hostpoint, Neue Jonastrasse 60, 8640 Rapperswil-Jona. Other data is stored on Zoo Zurich's own physical servers in Switzerland.

    This serves the efficient management of personal data and allows Zoo Zurich to respond adequately to the concerns of users, and enables the efficient provision of the services requested by users and processing of the associated contracts.

    Zoo Zurich analyses this data in order to further develop the offers in a manner that is based on needs and to display and suggest the most relevant information and offers to the users. Zoo Zurich may also use methods that predict possible interests and future orders based on the use of the Platform. These analyses can create profiles about the users.

    Users can object to the analysis of personal data for advertising purposes and the creation of user profiles at any time (see below under «Contact»).
     

    Disclosure of data to third parties

    Zoo Zurich only discloses personal data if the users have expressly consented, if there is a legal obligation to do so, or if this is necessary to enforce the rights of Zoo Zurich, in particular to enforce claims arising from the contractual relationship.

    Personal data may be forwarded for certain functionalities and services. In these cases, users will be informed of this transfer to third parties. Zoo Zurich will not disclose personal data to third parties without the express consent of the user. However, it may not be possible to perform certain functionalities and services without the disclosure of personal data to third parties.

    In addition, Zoo Zurich discloses personal data to third parties insofar as this is necessary within the framework of the use of the Platform and for the provision of the services and functionalities requested by the users. The use by the third parties of the data disclosed for this purpose is strictly limited to the aforementioned purposes.

    Various third-party service providers are explicitly mentioned in this privacy policy. Another service provider to whom personal data is disclosed or who has or may have access to personal data is the web host Hostpoint, Neue Jonastrasse 60, 8640 Rapperswil-Jona. The Platform is hosted on servers in Switzerland.

    In the case of users who are customers of sponsoring partners (Zürcher Kantonalbank, EWZ, Mobiliar, Migros Genossenschaftsbund Zürich and Tchibo) and who take advantage of discounts and other benefits offered by Zoo Zurich via these sponsoring partners, Zoo Zurich will transmit corresponding information to the sponsoring partner in question so that it can analyze how many of its customers have accessed Zoo Zurich services via its portal.

    In the case of functionalities requiring payment where Zoo Zurich offers online payment, the payment information, in particular card information, is passed on to the service providers involved in making the payment. Card issuers may have additional data processing provisions.

    Data will also be shared with swiss moonshot AG (aiaibot.com), Hardturmstrasse 105, 8005 Zurich, which provides the chatbot on the Platform for Zoo Zurich. However, this is generally not personal data. As soon as users interact with the chatbot, a user ID is generated. However, this is not linked to information that would allow identification. Since the chatbot offers standardized answers to certain questions and the users therefore do not make any entries of their own, no personal data is collected during these actions either. Only when users provide feedback at the end of the interaction might users voluntarily provide personal information. By default, this is not provided.

    Transfer of personal data abroad

    Zoo Zurich is entitled to forward personal data to third-party companies abroad if this is necessary in connection with the processing of inquiries, the provision of services and marketing campaigns, and the execution of orders. These third parties are obliged to maintain the privacy of users to the same extent as Zoo Zurich itself. If the level of data protection in a country is deemed inadequate within the meaning of Swiss data protection law, Zoo Zurich shall ensure by means of a contract that the personal data is protected at all times in accordance with the Swiss level of data protection.

    Various third-party service providers and their registered office addresses are explicitly mentioned in this privacy policy. Some of the third-party service providers mentioned in this privacy policy are located in the USA.

    For the sake of completeness, Zoo Zurich notes that the U.S. authorities can carry out surveillance measures under U.S. legislation, under which the general storage of all data forwarded from the European Union and Switzerland to the U.S. is possible. This is done without distinction, limitation, or exception based on the objective pursued and without objective criteria that would make it possible to limit U.S. authorities' access to and subsequent use of personal data to specific, strictly limited purposes that would justify access to such data.

    Zoo Zurich hereby draws the attention of users residing in Switzerland to the fact that, from Switzerland's point of view, the USA does not have a sufficient level of data protection due to the issues mentioned in the preceding paragraph, among other things. Insofar as recipients of data (e.g. Google) are based in the USA, Zoo Zurich will ensure through contractual arrangements with these companies, in particular through the conclusion of the revised standard contractual clauses and the possible implementation of further measures, that personal data is protected at an appropriate level with these partners.

    Integration of third party services and content

    It may happen that third-party content is integrated within the Platform, such as videos from YouTube, map material from Google Maps, audio files from Soundcloud or graphics from other websites. This always assumes that the providers of this content (hereinafter referred to as «third-party providers») use the IP address of the users. Without the IP address, they could not send the content to the browser of the respective user. The IP address is therefore required for the display of this content. Zoo Zurich has no influence if the third-party providers store the IP address, e.g. for statistical purposes. It is also possible that third-party providers use cookies (cf. «Cookies»).

    Contact

    When contacting Zoo Zurich (for example by contact form or email, application by email), the user's details are stored for the purpose of processing the request and in case follow-up questions arise. After the end of the processing purpose, the user's data will be erased. However, the information may be anonymized and still kept and processed for statistical purposes.

    Security measures

    Zoo Zurich provides for security measures with its hosting providers to protect the databases as well as possible against unauthorized access, loss, misuse or falsification of information and personal data.

    However, the transmission of data via the Internet can never be 100% secure. As soon as Zoo Zurich has received the transmitted information, it will secure it in its systems in an appropriate manner. It is the user's responsibility to ensure the security of his Internet connection. Any claims by users for damages resulting from the use of an unsecured connection, in particular for any damage to his or her hardware or software, loss of data or other forms of loss attributable to use of the service, are excluded, unless the event causing the damage was caused by intentional or grossly negligent conduct on the part of Zoo Zurich. The use of the publicly accessible Internet is therefore at the user's own risk.

    Access to personal data is limited to those employees and third parties who need to know the data. The persons and companies concerned are bound to secrecy and to compliance with the applicable data protection laws. Zoo Zurich will never sell or otherwise market personal data to third parties.
     

    Data storage

    Zoo Zurich stores personal data only for as long as is necessary to carry out the processing operations explained in this privacy policy. In the case of contractual data, storage is subject to statutory retention obligations. Requirements that oblige Zoo Zurich to retain data arise from accounting regulations and tax law provisions. According to these regulations, business communications, concluded contracts and accounting records must be retained for up to 10 years. Insofar as Zoo Zurich no longer requires this data to perform services for the customer, the data will be blocked. This means that the data may then only be used if this is necessary to fulfill retention obligations or to defend and enforce legal interests. The data is erased as soon as there is no longer any obligation to retain it and no longer any legitimate interest in retaining it.

    Right to information and disclosure

    Provided that the legal requirements are met, users have the following rights as data subjects:

    Right to disclosure

    Users have the right to inspect their personal data stored by Zoo Zurich at any time and free of charge if Zoo Zurich processes such data. This gives users the opportunity to check what personal data Zoo Zurich processes about users and that Zoo Zurich uses this data in accordance with applicable data protection provisions.

    Right to rectification

    Users have the right to have incorrect or incomplete personal data rectified and to be informed about the rectification. In this case, Zoo Zurich will inform the recipients of the data concerned of the adjustments made, unless this is impossible or involves disproportionate effort.

    Right to erasure

    Users have the right to have their personal data erased under certain circumstances. In individual cases, especially in the case of statutory retention obligations, the right to erasure may be excluded. In this case, the erasure may be replaced by blocking of the data if the conditions are met.

    Right to restrict processing

    Users have the right to request that the processing of their personal data be restricted.

    Right to data portability

    Users have the right to receive from Zoo Zurich, free of charge, the personal data that users have provided to Zoo Zurich in a readable format.

    Right to object

    Users may object to data processing at any time, in particular data processing in connection with direct advertising (e.g. advertising emails).

    Right of revocation

    Fundamentally, users have the right to revoke their consent at any time. However, processing activities based on consent in the past do not become unlawful as a result of the revocation.

    Zoo Zurich is obligated to verify the identity of the applicants in the case of such requests. Requests can therefore only be processed if they are accompanied by suitable proof of identity.

    Information to authorities

    Zoo Zurich may be required to disclose users' contact, usage and border data to entitled authorities.
